2. The petitioner seeks bail in connection with Nautan P.S.Case No. 118 of 2024 registered for the offence punishable under Sections 365 and 366 of the Indian Penal Code and the charge sheet has been submitted under sections 302, 201,120B/34 of the Indian Penal Code.
3. As per the FIR, the wife of the informant had left the house with Rs. 50,000/- , jewellery and her three children.
4. Learned cousnel for the petitioner has submitted that husband of the victim has been made accused in this case. He along with one co-accused Mithlesh Kumar and Saukat Ali is said to have killed the deceased. Materials including self -inculpatory statement of one co-accused Tunna Alam and Noor
Patna High Court CR. MISC. No.59285 of 2024(2) dt.28-08-2024 2/2 Alam, it had come that the petitioner had participated in killing the deceased with the husband of the deceased that is the petitioner had caught hold of the deceased and the husband of the deceased had killed the deceased. The petitioner is in jail since 18.03.2024.
5. Considering the facts and circumstances of the case and also the fact that petitioner has actively participated in killing of the deceased, this Court is not inclined to grant bail to the petitioner.
6. Accordingly, the application for regular bail of the petitioner is dismissed. The petitioner may renew his prayer for bail, if the prosecution party delays the trial.
7. The Superintendent of Police, West Champaran is directed to get the trial expedited by producing witnessed. Let a copy of this order be communicated to the Superintendent of Police, West Champaran forthwith, through FAX for its compliance.
