The petitioners apprehend their arrest in Araria P.S. Case No. 570/2016, registered for the offences punishable under Sections 406, 420, 120B and other sections of the Indian Penal Code.

The informant filed complaint petition alleging therein that he sold 17 decimals of land of Khesra no. 686 Khata no. 203 on 27.10.2015 in favour of the petitioners, but the accused persons inserted more lands of different Khata and Khesra number of the informant fraudulently.

Learned counsel for the petitioners submits that the

Patna High Court Cr.Misc. No.49549 of 2016 (2) dt.16-12-2016 2/2 informant executed the sale deed and accepted the execution of the sale deed in presence of the Registrar, whereas, learned counsel for the informant submits that page of the sale deed has been changed. It appears that dispute is of civil nature. Considering the facts aforesaid and nature of allegation made against the petitioners and the fact that dispute is of civil nature, the petitioners above-named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Araria P.S. Case No. 570/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Jha, J.) Vinita/- U T
