The petitioner seeks regular bail in connection with Rajepur P.S. Case No. 136 of 2016 registered for the offences punishable under Sections 341, 342, 323, 324, 307, 364A and 120B of the Indian Penal Code.
As per written report, the son of the informant was kidnapped by three or four unknown persons, who got down from Bolero vehicle and lifted his son. At that time they had covered their face and they also assaulted the informant on his head by lathi and danda. The informant allegedly disclosed about the presence of few persons, who are named in the F.I.R. and on the basis of his version, the present case has been registered.
Patna High Court Cr.Misc. No.5576 of 2017 (2) dt.07-02-2017 2/2 Learned counsel for the petitioner submits that this petitioner was arrested by the police and allegedly recorded his confession. The persons, who were named in the F.I.R. on the basis of disclosure made by this petitioner, have already been allowed bail by sessions Judge. The statement of the petitioner has got no evidentiary value in the eye of law as this petitioner has simply disclosed the names of F.I.R. named persons, who had assembled at the place of taking wine. Learned counsel for the petitioner further submits that the petitioner is in custody since 30.10.2016, having no criminal antecedent. Considering the facts and circumstances of the case, the bail prayer is allowed and petitioner Rajmangal Sah is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Sadar at Motihari, East Champaran in connection with Rajepur P.S. Case No. 136 of 2016.
