JUSTICE BIRENDRA KUMAR ORAL ORDER 09-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 302/120B/34 of the Indian Penal Code.

The informant is not eyewitness of the occurrence. For old dispute he suspected that the petitioner had committed the murder of her father. After investigation the police did not sent up the petitioner for trial. However, on protest petition cognizance has been taken against the petitioner.

Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the

No.49472 of 2016 (2) dt.09-12-2016 2/2 Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Bhabua (Kaimur)/Successor Court in connection with Complaint Case No.45 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
