2. The petitioner seeks bail in connection with Bikram P.S. Case No. 345/2024, registered for the offence under Sections 127(2), 115(2), 308(5), 303(2), 352, 351(2), 351(3) and 3(5) of the Bhartiya Nyay Sanhita (BNS), 2023.
3. The accused/petitioner is named in the F.I.R. and is in custody since 28.04.2025.
4. The allegation against the petitioner is to demand an extortion of Rs. 10 lacs from the informant and also to assault him by using butt of pistol.
5. Mr. N.K. Agrawal, learned senior counsel while arguing for the petitioner submitted that the petitioner and informant were known to each other since last ten years of the
Patna High Court CR. MISC. No.53353 of 2025(4) dt.26-09-2025 2/3 alleged occurrence. It is pointed out that petitioner runs the flour mill in Deoghar and transferred Rs. 5 lacs to the informant for purchase of wheat on 08.02.2024 through R.T.G.S. from the account of his firm, namely, M/s Prince Raj Traders. Petitioner also had given cash of Rs. 5 lacs to the informant. It is submitted that despite of repeated request and even after taking the best efforts of the petitioner, the informant returned only money of Rs. 85,000/- to the petitioner on 20.03.2024 and Rs. 5000/- on 14.07.2024 i.e. total of Rs. 90,000/-. It is pointed out that when repeated request was made by petitioner for balance amount, the present false case was lodged. It is also submitted by Mr.
Agrawal that the injury report of the informant suggest that he received simple injury during the course of occurrence.
6. Learned APP opposed the prayer of bail.
7. Considering the aforesaid factual submissions and by taking note of fact as prima facie petitioner appears acquainted with the informant out of business/financial relation, coupled with

No.53353 of 2025(4) dt.26-09-2025 3/3 the fact that investigation of this case is already completed, where petitioner remains in custody since 28.04.2025, accordingly, petitioner above named, is directed to be released on bail in connection with Bikram P.S. Case No. 345/2024 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Danapur, Patna/concerned Court, subject to the conditions as mentioned under Section 437(3) of the Cr.P.C./Section 480(3) of BNSS.
