JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 05-05-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Danapur P.S. Case No. 481 of 2016 registered under Sections 399/402 of the Indian Penal Code and Sections 25(1-b)a, 26, 35 of the Arms Act.

Accusation is that when the Officer incharge of Danapur Police station, having got secrete information that three motorcycles are standing inside the East Gola road and some persons are gathered there, he along with other police personnel went there, then three persons succeeded in fleeing away and six persons including the petitioner were apprehended and on search petitioner was found in possession of one country made pistol with

Patna High Court Cr.Misc. No.18641 of 2017 (2) dt.05-05-2017 2/2 two live cartridges.

Submission is that prior to the present case, the petitioner had no criminal antecedent and after apprehending by the police in the present case, the petitioner has been remanded in Danapur P.S. Case No. 471 of 2016, registered under Sections 384, 387, 307 and 120B of the Indian Penal Code and 27 of the Arms Act. The petitioner is in custody since 23.11.2016. Having regard to the facts and circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Danapur, Patna in connection with Danapur P.S.
