The petitioners apprehend their arrest in connection with Mohania P.S. Case No. 639 of 2017 for the office registered under Sections 406, 420, 467 and 468 of the Indian Penal Code.

Learned counsel for the petitioner submits that the entire case is false and fabricated and the story of mortgage has been created only to harass the petitioner and extract money from him. It is further submitted that the paper of mortgage was purchased on 20.01.2015 by the informant and from the recital it is not clear as to which was the part and parcel of land which had been mortgaged and for which, money had exchanged hands.

Considering the aforesaid facts and

Patna High Court Cr.Misc. No.16362 of 2018 (2) dt.09-04-2018 circumstances of the case and that the petitioners have no criminal antecedent, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kaimur at Bhabua in connection with Mohania P.S. Case No. 639 of 2017 subject to the condition as laid under Section 438(2) Cr.P.C.
