JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-11-2019 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Muffasil (Lakho) P.S. Case No. 126 of 2014 corresponding to Sessions Trial No. 421 of 2016, registered for the offences punishable under Sections 147, 148, 149, 302 of the Indian Penal Code and section 27 of the Arms Act.

Petitioner is alleged to have shot fire upon the chest of Sandip Kumar (deceased), as a result of which, he died on the way while he was taken to the hospital.

From perusal of the impugned order, it appears that out of fifteen chargesheeted prosecution witnesses, seven prosecution witnesses have already been examined, rest eight witnesses, including informant, Investigating Officer and eye-

Considering the facts aforesaid, nature of allegation and the fact that petitioner is the main assailant, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.

The trial court is directed to conclude the trial within a period of one year from today.
