JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-04-2018 Heard counsel for the petitioner and counsel appearing on behalf of the State as well as the Informant. The petitioner is apprehending arrest in connection with Bakhtiarpur P.S. Case No. 286 of 2017 for offences under Sections 147, 148, 149, 307, 324, 427, 504, 506 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. There is case and counter case out of the same transaction. The case of the petitioner was lodged immediately after the occurrence on 23.5.2017 whereas the case of the informant was lodged on 21.8.2017. Considering the fact that there is dispute for plucking of vegetable and some altercation took place in which the informant has sustained injury and there is no criminal

Let the petitioner, above named, in the event of arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri S.K.Modi, Chief Judicial Magistrate, Saharsa in connection with Bakhtiarpur P. S. Case No. 286 of 2017, subject to the conditions as laid down under Section 438(2) Cr. P. C.
