The petitioners seek bail in a case registered under Section 392 of the Indian Penal Code.

Allegation against the petitioners is that they were involved in loot of pick up van.

It has been submitted on behalf of the petitioner that the petitioners are in custody since 13.05.2019 and have got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners are not named in the F.I.R. Their name has come on confessional statement of co-

Patna High Court CR. MISC. No.50369 of 2019(2) dt.13-08-2019 2/2 accused. The petitioners were not put on T.I.P. There is no recovery of any incriminating article from the possession of the petitioners. Co-accused has been granted bail vide Cr.Misc.No.47737 of 2019.

On behalf of the State, it is submitted that the petitioners are not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Vaishali at Hajipur in connection with Jandaha P.S. case No.97 of 2019.
