Petitioner apprehends arrest in a case registered for the offences punishable under Sections 272, 273/34 of Indian Penal Code and Section 30(a), 36, 32(3) of the Bihar Prohibition and Excise Act, 2016 (Amendment 2018).

As per prosecution case, 250 litres toddy has been recovered from pick-up van.

Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in this case. Petitioner is neither driver nor owner of the vehicle in question. Nothing has been recovered from the conscious possession of the petitioner and he is in no way connected with the aforesaid recovery. Petitioner has got no criminal antecedent.

No.54199 of 2022(2) dt.18-11-2022 2/2 Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Exclusive Special Judge, Excise, Court No. II, Muzaffarpur in Muzaffarpur Excise P. S. Case No. 488 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
