2. The petitioners apprehend their arrest in connection with Atri P.S. Case No. 138 of 2024, registered for the offences punishable under Sections 341, 323, 427, 379, 307 and 34 of the Indian Penal Code and Section 27 of the Arms Act.
3. The informant, who is said to be the Manager of Maharani Services, engaged in settlement of sand ghat, has instituted the present FIR with an allegation that the petitioners along with six other FIR named and 10 unknown persons came to the office of the informant and damaged the vehicles which were parked there. There is further allegation that the accused

4. Learned Advocate for the petitioners submitted that only because of the fact that the petitioner No.1 and 2 having some criminal antecedents, their names have been implicated in this case on account of suspicion. All the more, there is omnibus nature of allegation against eight named accused persons including the petitioners and ten unknown persons without there being making any specific overt act. It is the admitted position that in the said occurrence none has sustained any injury. However, later on the good sense prevailed and the parties have also compromised the matter and they do not want to proceed further.
5. On the other hand, learned Advocate for the State vehemently opposed the bail application and submitted that besides the active participation petitioner No.1 bears one criminal antecedent; whereas petitioner No. 2 is facing six criminal cases over his head.

Regard being had to the submissions made on behalf of the parties and considering the nature of allegations coupled with the fact that the parties have later on settled the dispute, let the petitioners abovenamed be released on bail, in the event of their arrest or surrender before the court below
Patna High Court CR. MISC. No.58503 of 2025(3) dt.12-11-2025 3/3 within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya, in connection with Atri P.S. Case No. 138 of 2024, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023, with the further condition that one of the bailors shall be the own/close family members of the petitioners.
