The petitioners apprehend their arrest in connection with G.R.Case No. 2890 of 2015 arising out of Goraul P.S.Case No. 188 of 2015 for the offences alleged under Sections 363 and 365 of the Indian Penal Code.
The prosecution case, as stated in the fardbeyan of Amarjeet Kumar son of Sanjeev Singh resident of villageAsatpour Satpura, P.S. Bhagwanpur, District- Vaishali , is that one month before 12.06.2015, the informant was repairing his bicycle at a shop below the Belwar Ghat. At that time two persons riding

No.52043 of 2015 (2) dt.17-12-2015 2/3 on a motor cycle, namely, Raj Kishore Singh and Bhogia Singh came there and asked him whether he wanted to go to Satpura for irrigation work. Thereafter they took the informant in the motorcycle. Instead of going to Satpura the said two persons tied his mouth and brought him to the house of Ram Naresh Singh (petitioner no.1) and his son Sujit Singh (petitioner no.2) and his daughter Khushboo Devi assaulted him with fists and slaps and confined him in a room for a month. The further prosecution case is that the petitioners and other accused wanted to grab the land. It has been submitted by the counsel for the petitioners that in the deposition the informant has stated that there is a land dispute between him and the petitioners.
It has further been submitted that the petitioners are relatives and compromise between them has taken place, which finds place at Annexure 5 to this petition. Furthermore, it is submitted that due to land dispute a number of cases have been lodged against petitioner nos. 1 and 2 and another case has been lodged against petitioner nos. 1 and 2 i.e. Lalganj P.S.Case No. 148 of 2015.
Be that as it may, let the petitioners, above named, in the event of their arrest/surrender before the court below within a period of six weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two
Patna High Court Cr.Misc. No.52043 of 2015 (2) dt.17-12-2015 3/3 sureties of the like amount each to the satisfaction of learned S.D.J.M., Hazipur in connection with Goraul P.S.Case No. 188 of 2015 (G.R.No. 2890 of 2015), subject to the conditions, as laid down u/s 438(2) Cr.P.C.
