JUSTICE BIRENDRA KUMAR ORAL ORDER 24-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is languishing in custody for the offences punishable under Section 307 of the Indian Penal Code and Section 27 of the Arms Act.

The FIR was lodged on 23.11.2016 with allegation that unknown persons caused fire arm injury to the informant. Learned counsel for the petitioner submits that only material against the petitioner is confessional statement of coaccused wherein co-accused Santosh Sah confessed that he had fired and the petitioner was along with him.

Since no overt act is attributed to the petitioner, let petitioner, above named, be enlarged on bail on furnishing bail

Patna High Court Cr.Misc. No.12828 of 2017 (3) dt.24-04-2017 bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Madhepura/Successor Court, in connection with Singheshwar P.S. Case No.232 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court below shall be at liberty to take steps for cancellation of the bail bonds of the petitioner in this case.
