JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 13-10-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner has renewed his prayer for bail which was earlier directed to be withdrawn vide order dated 19.05.2023 passed in Cr. Misc. No. 12643 of 2023 with a direction to the trial court to conclude the trial within a period of two months as the report of the trial court suggested that trial would be concluded within two months.

In pursuance to the direction of this Court, a fresh report with regard to the present stage of the trial has been received which has been kept at Flag-P. The report of learned Additional District &

Patna High Court CR. MISC. No.54853 of 2023(3) dt.13-10-2023 2/2 Sessions Judge-III-cum-Special Court, MP/MLA, Nalanda at Biharsharif dated 04.09.2023 suggests that out of eight prosecution witnesses, three witnesses have already been examined and for rest of the witnesses, B/W has already been issued. The trial is likely to be concluded within four months.

In that view of the matter, this Court is not inclined to grant the privilege of bail to the petitioner for the present.

Accordingly, the petition is disposed off with a direction to the Trial Court to expedite the trial and conclude the same within a period of four months from today as incorporated in its report dated 04.09.2023. The petitioner will be at liberty to renew his prayer for bail, if the trial is not concluded within four months.
