JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-03-2017 The petitioner is in custody since 28.09.2016 in connection with Khodawanpur P.S. Case No. 23 of 2016, registered for offences punishable under Sections 147, 148, 149, 307, 302 and 34 Indian Penal Code.

It has been submitted on behalf of the petitioner that no specific allegation of assault has been levelled against this petitioner rather specific allegation of assault has been levelled on other co-accused persons, namely, Ranjit Singh and Anjani Singh and petitioner has no criminal antecedent and has been in judicial custody since 28.09.2016 and other co-accused having similar allegation has already been granted bail by this Court vide order dated 02.06.2016 passed in Criminal Miscellaneous No. 23315 of 2016 and vide order dated 12.07.2016 passed in Criminal

Patna High Court Cr.Misc. No.14503 of 2017 (2) dt.30-03-2017 2/3 Miscellaneous No. 25015 of 2016.

Learned counsel for the State also could not controvert the aforesaid fact.

Having heard both sides, considering the facts and circumstances of the case, period of custody and also that other co-accused having similar allegations have already been granted bail by this Court, as such, let petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Manjhaul, Dist - Begusarai, in connection with Khodawanpur P.S. Case No. 23 of 2016, subject to the following conditons:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the
