JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 14-08-2019 As prayed for, learned counsel for the petitioner is permitted to make necessary correction in the prayer portion of this application with regard to name of the District of the court within course of the day.

Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Karpi P.S. Case No.105 of 2019 registered under Sections 341, 323, 354(B) and 379/34 of the Indian Penal Code.

The accusation is that in the morning of 07.06.2019, when the informant Bindu Devi was going to field to attend the call of nature, then this petitioner caught hold of her hand. When the informant made protest, then this petitioner caught hold of hair of the informant and started to cause assault and also tried to outrage her

Thereafter, two sons of the petitioner came there and caused assault to the informant through feets and slaps. Learned counsel for the petitioner submits that due to some petty dispute, the occurrence of "Maar-Peet" took place between the parties, who are aganates, and regarding the same occurrence, on the basis of the fardbeyan of Lalti Devi, the sister-inlaw of the petitioner, Karpi P.S. Case No.106 of 2019 was also instituted against the informant and others. The petitioner has no criminal antecedent.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Arwal, in connection with Karpi P.S. Case No.105 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C.
