The petitioner is languishing in custody for the offences punishable under Sections 341/323/307/504/34 of the Indian Penal Code and Section 27 of the Arms Act. There is case and counter case. Allegation against the petitioner and others is of firing which caused injury at the lower limb of different persons.

Submission is that petitioner's side also sustained injury at the hands of the prosecution side. The petitioner has stated on oath that he has got no criminal antecedent. Petitioner is aged about 60 years.

Considering the aforesaid fact, let the petitioner,

Patna High Court CR. MISC. No.50163 of 2019(2) dt.13-08-2019 2/2 above named, be released on bail after completion of investigation on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Baikunthpur P.S. Case No.133 of 2019, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Mkr./- U T
