The Petitioner seeks bail in Agamkuan P.S. Case No. 329 of 2016, G.R. No. 2903 of 2016 instituted for the offence under Sections 341, 326, 307/34 and 302 of the Indian Penal Code and Section 27 of the Arms Act.
It has been submitted on behalf of the petitioner that he is not named in the written report. His name has come in the confessional statement of co-accused Md. Belal, who has already been granted bail by a co-ordinate Bench of this Court by order dated 9.5.2017 passed in Cr. Misc. No. 9552 of 2017. In the written report, it is alleged that three unknown persons had shot at the deceased. In the impugned order of the
Patna High Court Cr.Misc. No.17595 of 2017 (5) dt.18-05-2017 2/2 Sessions Judge mention has been made about the statement of the witnesses in paras 15, 16 as well as 33 wherein suspicion has been raised against the petitioner. Thereafter Md. Belal has taken the name of the petitioner in his confessional statement as recorded in para-47 of the case diary.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Patna City in connection with Agamkuan P.S. Case No. 329/2016, G.R. No. 2903 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
