JUSTICE SANJAY PRIYA ORAL ORDER 11-04-2018 Heard learned counsel for the petitioner and the State. Prayer for anticipatory bail of this petitioner was earlier rejected by this Court on merit vide order dated 18.10.2017 passed in Cr. Misc. 29583 of 2017.
Learned counsel for the petitioner has submitted that police has not submitted charge sheet under Section 307 of the Indian Penal Code against the petitioner, but the court below took cognizance for the offence under Section 307 of the Indian Penal Code.
The earlier anticipatory bail application of petitioner was rejected on merit.
Therefore, this Court does not find any fresh ground to grant anticipatory bail to the petitioner.
Patna High Court Cr.Misc. No.15060 of 2018 (2) dt.11-04-2018 2/2 Prayer for anticipatory bail of petitioner stands rejected. Petitioner may surrender before the court below within a period of four weeks from the date of receipt of this order and make prayer for regular bail which shall be considered by the court below in accordance with law without being prejudiced by this order.
