Patna High Court CWJC No.9236 of 2011 (11) dt.08-01-2015 2/2 A joint affidavit affirmed by them has also been filed today. As per the averments made in the joint affidavit 10 post dated cheques of Rs. 50,000/- each totalling Rs. 5 Lakhs have been handed over to the petitioner by the respondent no.5 starting from 16.01.2015 to 19.07.2015. It has also been stated that the petitioner shall be entitled to his rights to movable and immovable properties of the respondent no. 5 and that the respondent no. 5 has agreed to bear the day to day liability of the petitioner and both are living together with their family under the same roof. In view of the dispute having been settled, as agreed between the parties, the application stands disposed off. It is hoped that the post dated cheques would be honoured and the respondent no. 5 will keep sufficient fund in his account for the said purpose. If any of the cheques are not honoured, the petitioner shall have the liberty to move this Court in the present proceeding itself by filing an Interlocutory Application.
