JUSTICE SHAILENDRA SINGH ORAL ORDER 11-09-2025 The instant writ petition has been filed by the petitioner under Article 226 of the Constitution of India, seeking the following reliefs :- " (a). For that an appropriate direction or directions may be given to the concerned respondents not to construct the road on the personal raiyati land of the petitioner bearing Khata No. 153, Khesra No. 1389 and the same may be constructed on the old road which was define in the Najri map.

(b). For thаt аn appropriate direction or directions may be given to the concerned respondents to make the payment of appropriate and reasonable compensation to the petitioner for the land being used in the construction of the road i.e.

Patna High Court CWJC No.14452 of 2025(2) dt.11-09-2025 2/3 the rate fixed for the residential land in the said area, (c). That the petitioner further prays for any other relief/reliefs which the petitioner may be found to be entitled in the facts and circumstances of the present case."

2. Heard Mr. Pritish Ranjan, learned counsel for the petitioner and learned Standing counsel-15 for the Staterespondents.

Learned counsel for the petitioner submits that the petitioner is the owner of his raiyati land pertaining to Khata No. 153, Khesra No. 1389, situated at Mauza Sasamusha, PS.- Kuchaikote, District - Gopalganj, Bihar, having his peaceful possession over the same. Initially, in the year 2010, the respondent authorities took steps to construct a road over the petitioner's land, thereafter, the petitioner objected, whereupon the petitioner's land was measured and no further action was taken for the construction of the road. But, in the year 2025, the District administration again started construction work for the road over the petitioner's land and thereafter, the petitioner approached the District Magistrate, Gopalganj, for raising his grievance and seeking redressal of the same, of which a copy has been filed with this petition as Annexure- 'P/3' but upon that application, no action has been taken till date. It is further

Considering the aforesaid submissions and the nature of grievance raised by the petitioner, the District Magistrate, Gopalganj (Respondent No. 3) and Circle Officer, Kuchaikote, Gopalganj (Respondent No. 4), are hereby directed to look into the petitioner's matter and take effective remedial steps to redress his grievance, if he has a bonafide issue, in the next four weeks from the date of receipt of a copy of this Court's order, and communicate the action taken step to the petitioner in writing.
