JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-11-2015 The petitioner being the husband of the informant renewed his prayer for anticipatory bail in a case registered for the offences punishable under Sections 323, 379 and 498A/34 of the IPC and Section 3/4 of the Dowry Prohibition Act. Earlier the anticipatory bail of the petitioner was rejected vide Cr. Misc. No. 42645 of 2005.
The petitioner has renewed his prayer for anticipatory bail on the ground that the informant has performed second marriage with one Ashok Kumar Singh and the informant has retracted from her initial version and filed a petition to that effect before the learned court below.
Let the learned court below consider the prayer for regular bail of the petitioner in view of compromise petition filed by the informant if he surrenders within a period of six weeks in
Patna High Court Cr.Misc. No.52103 of 2015 (2) dt.06-11-2015 2/2 connection with Chapra Muffasil P.S. Case No. 310 of 2013 pending in the court of learned SDJM, Chapra. Accordingly, the application is disposed of.
