ANJANA MISHRA ORAL ORDER 29-10-2015 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Dalsingsarai P.S. Case No.174 of 2013 for allegedly having committed the offence under Sections 363, 364, 365, 366, 302, 368 and 120B/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is the father-in-law of the girl who had disappeared after being given Bidagiri by her father (the informant) and the girl had left along with her husband Kamal Kumar alias Chintu to be taken to his place of working. So far as this petitioner is concerned, he is the father-in-law of the girl, who had disappeared and is suspected to have been killed. The petitioner
Patna High Court Cr.Misc. No.29210 of 2015 (5) dt.29-10-2015 2/2 is being prosecuted because he had opposed the marriage of his son Kamal Kumar alias Chintu with the victim girl and, therefore, the informant has pointed finger towards this petitioner.
Considering the aforementioned facts and circumstances and also that in the case diary there is no further cogent material so as to implicate this petitioner save and except the suspicion, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Dalsingsarai, in connection with Dalsingsarai P.S. Case No.174 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
