The present application, under Section 439(2) of the Code of Criminal Procedure, has been filed seeking cancellation of anticipatory bail granted to opposite party No. 2, who is on bail in connection with Aurai P.S. Case No.

Patna High Court Cr.Misc. No.55664 of 2016 (2) dt.09-01-2017 2/2 142 of 2016, registered for the offences punishable under Sections 420, 465, 468 and 471 of the Indian Penal Code, from the Court of learned Sessions Judge, Muzaffarpur. Learned counsel for the petitioner has submitted that one transaction may have criminal as well as civil consequences and opposite party No. 2 has been granted the privilege of anticipatory bail by making an observation that the dispute is of civil nature.

I do not find any merit in this plea, seeking cancellation of bail. However, the said observation that the dispute is of civil nature will not prejudice the merit of the case of the prosecution in any manner.

This application stands disposed of.
