2. The petitioner is in custody since 20.01.2017 for the alleged offence under Section 366 of the Indian Penal Code registered in connection with Dulhin Bazar P.S. Case No. 237 of 2016.

3. It is submitted that the petitioner has been falsely implicated and in any event, there is no accusation that the petitioner forced the victim girl into physical relationship. The petitioner claims clean antecedents.

4. It appears that the statement of victim girl has since been recorded and according to her deposition under Section 164 of the Cr.P.C., age of the victim girl is stated to be 16 years and she has named the petitioner and there is direct accusation that the petitioner had taken away the victim girl with him on train to Gujarat and established physical relationship with her.

5. Having regard to the nature of accusations and gravity of offence alleged, this Court is not inclined to grant the privilege of bail to the petitioner. The bail petition stands dismissed. (Vikash Jain, J) B.T/- U T
