The petitioner is apprehending his arrest in a case registered under Section 47 of the Bihar Excise Act, 2016. Allegation is that the informant recovered 182 bottles of foreign liquor from a Bolero jeep loaded on the same through the accused.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. It is alleged that 123 liters of foreign liquor is said to have been recovered from the possession of co-accused. The petitioner is not named in the F.I.R. His name has come on the confessional statement of the

Patna High Court Cr.Misc. No.50389 of 2016 (2) dt.25-11-2016 2/2 co-accused. There is no recovery of wine from the conscious possession of the petitioner.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Sonepur, Saran at Chhapra in connection with Sonepur Rail P.S. case No.59 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
