2. The petitioner apprehends his arrest in a case registered for the offence under Sections 406/420 of I.P.C.
3. It is alleged that this petitioner induced and persuaded informant to purchase land from co-accused Sunaina Devi. On whose persuasion, informant invested huge amount in the account of co-accused Sunaina Devi, who was having no land. Thus, this petitioner alongwith other accused persons defrauded amount of Rs. 58,25,000/- of informant.
4. Learned counsel for the petitioner submits that petitioner is quite innocent and has been falsely implicated in this case. As per F.I.R., the said occurrence took place on 01.07.2023, but F.I.R. has been lodged on 24.04.2024 after lapse of more than 9 months and there is no plausible explanation of delay. He further submits that in the entire transaction of money, no amount has been credited in the bank account of this

For the purpose of purchasing the land in question, the informant transferred Rs. 26,40,000/- in the account of coaccused Sunaina Devi through RTGS and cash of Rs. 5,10,000/- in the account of co-accused Rajesh Kumar Chaurasiya. Petitioner is posted as Audit Officer in the office of Director General of Audits (Mines), Kolkata and has got no concern with the same. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State and learned counsel for the informant oppose the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali (Hajipur) in connection with Hajipur (Town) P.S. Case No. 274 of 2024, subject to condition as laid down under Section 438(2) of the Cr.P.C. / Section 482(2) of the B.N.S.S.
