JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 12-04-2017 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner wants to renew his prayer of bail, which was earlier dismissed as not pressed vide order dated 14.10.2015 passed in Cr. Misc. No. 27185 of 2015 and vide order dated 24.08.2016 passed in Cr. Misc. No. 30362 of 2016, on the ground that the case is fixed for defence witness and the court, where the trial was going on, is at present vacant and as such in near future the trial is not likely to be concluded.

Learned APP opposes the prayer of bail by submitting that it is now for defence to produce its witnesses. In the facts and circumstances stated above, finding no good ground for reconsideration of prayer for bail of the petitioner, again his prayer for bail stands rejected. However, learned trial court is again directed to conclude

Patna High Court Cr.Misc. No.14069 of 2017 (2) dt.12-04-2017 the trial within two months, failing which the petitioner, if at no fault, may be at liberty to renew his prayer of bail. It has been submitted that the court where the Sessions Trial No. 319 of 2015 was going on is vacant, under the circumstances, learned Sessions Judge, Munger is directed to look into the matter and if the court is vacant, then transfer the same to any other competent court so that trial could be completed within two months from the date of transfer of the case to a running court.
