The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 342/323/379/386 and 506/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the vehicle in question was purchased on instalments by the wife of the petitioner. The finance for the same had been received by the petitioner's wife from Chola Mandalam Investment and Finance Company. It is submitted that the informant, on false pretext and intention of grabbing the aforementioned vehicle stopped the truck while it was proceeding to Kolkata and tried to capture the same and further threats were also issued by the informant. Patna High Court Cr.Misc. No.58562 of 2015 (3) dt.09-05-2016 P2/2 submitted that the petitioner informed the local police station on 20.08.2015. It is next submitted that the petitioner has all the relevant papers for the purchase of the truck but yet he is being prosecuted for no fault of his own by the informant. Considering the nature of allegations made and that the petitioner has also referred to Annexure-2 which are payment receipts made by the wife of the petitioner which is also a part of the First Information Report and indicates the name of Poonam Devi as owner of the vehicle, let the petitioner, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Chapra Town P.S. Case No. 287/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
