The petitioner apprehends his arrest in connection with Karja P.S. Case No.128 of 2019 registered under Sections 30(a) and 38 of the Bihar Prohibition and Excise Act. The accusation is that on receiving secret information about keeping the liquor in the old Samudayik Bhawan in village-Ruksa by the petitioner, the informant along with other police personnel reached there and seized several bottles of Indian Made Foreign Liquour, kept in several cartoons. From there.

Learned counsel for the petitioner submits that, in fact, the petitioner the Chairman of the PACS and he had given

Thereafter, the District Cooperative Officer was trapped with bribed money and he was sent to jail. Due to that reason, the wife of the District Cooperative Officer, who is Jailor, has got managed to implicate the petitioner in the present case. Thereafter, the petitioner was made accused in three other cases of similar nature, as detailed in paragraph-3 to this application.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Muzaffarpur, in connection with Karja P.S. Case No.128 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C.
