In this case, the petitioner is seeking anticipatory bail in connection with Laukahi P.S. Case No. 62 of 2016 (G.R. No. 672 of 2016) registered for offence punishable under sections 420, 466, 467, 468 and 471 of the Indian Penal Code. The petitioner is a Panchayat Secretary. As per direction of this Court, the Panchayat Secretary was to submit the folder of Panchayat Teachers within the time prescribed, but the petitioner has only produced the folder of nine teachers and rest folders could not be deposited which is the cause for lodging of criminal case against him.
The learned counsel for the petitioner submits that

In view of above submission, the petitioner, in the event of arrest or surrender before the court below within six weeks from today, is directed to be enlarged on anticipatory bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Jhanjharpur, District-Madhubani in connection with Laukahi P.S. Case No. 62 of 2016 (G.R. No. 672 of 2016), subject to the conditions as laid down under section 438 Cr. PC and also subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court. The petitioner will not induce any witness or tamper with the evidence. The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court. If the petitioner would fail to submit all folders within the aforesaid period, the prosecution will have liberty to take action in accordance with law.
