JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 01-06-2017 Heard learned counsel for the petitioner and the State. In this case, case diary was called for vide order dated 10.05.2017.

The petitioner is an accused in Naokothi P.S. Case No. 87 of 2016 for the offence punishable under section 302/34 of the Indian Penal Code and Section 27 of the Arms Act. Counsel for the State on the basis of case diary submits that there is strong suspicion against the petitioner on account of previous enmity. There is no eye witness to the occurrence.

In view of the fact that there is no eye-witness and hearsay evidence on the basis of previous enmity is the only material against the petitioner involved in this case. In the facts

Patna High Court Cr.Misc. No.18672 of 2017 (4) dt.01-06-2017 2/2 and circumstances as mentioned above and the fact that the petitioner is in jail custody since 17.11.2016, let the petitioner, named above, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Naokothi P.S. Case No. 87 of 2016 on the condition that the petitioner will cooperate in the trial and will not, in any manner, influence the evidence or the witnesses. (Anil Kumar Upadhyay, J) Ravi/- U
