The petitioner is in custody in connection with Jamui (Town) P.S. Case No. 327 of 2019 for the offence under Sections 147, 149, 323, 341, 504, 379, 411, 353, 338 of the Indian Penal Code, Sections 4/40 of the B.M.M. Rules, 1972, 108(a) of Bihar Minerals Act, 2014 and Section 15 of the Forest Act.
Allegation against the petitioner is that he was involved in illegal mining of sand and its transportation. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 20.06.2019. He further submits that the petitioner was neither the owner nor the driver of the vehicle involved in lifting of sand.
