The petitioner seeks bail in Salkhua (Chiraiya O.P.) case No. 225 of 2016 under Section 307 and other minor Sections of the Indian Penal Code and under Section 25(1-b) a, 26, 27, 35 of the Arms Act.

The informant alleged that he got information that Ramanand Yadav, a dreaded criminal, along with his accomplice had assembled to commit crime. On such, a raid was conducted. The criminals opened fire but five criminals were arrested. The petitioner is one of them. From the possession of petitioner 70 cartridges and chargers were recovered.

The learned counsel for the petitioner submits that Roshan Yadav was also apprehended and from his possession one

Patna High Court Cr.Misc. No.19697 of 2017 (2) dt.03-05-2017 2/2 rifle was recovered but Roshan Yadav has already been enlarged on bail vide order passed in Cr. Misc. No. 18427 of 2017. The petitioner is in jail since 18.11.2016. The petitioner has remained in jail for five and half months.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri R. M. Tripathi, learned Additional Sessions Judge-I, Saharsa in Salkhua (Chiraiya O.P.) P.S. Case No. 225 of 2016, S. T. No. 19 of 2017.
