2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30 (a) of the Bihar Prohibition and Excise Act- 2022.

3. Prosecution case is that 1060.920 liters country made foreign liquor were recovered from car in question .

4. It is submitted that petitioner is neither driver nor owner of the car in question . No incriminating material has been recovered from the conscious possession of the petitioner. 5 . However, learned counsel for the State submits that petitioner has got one criminal antecedent of similar nature .

6. Considering the facts of the case as also the fact that petitioner has got one criminal antecedent of similar nature,
