Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The Petitioner seeks bail in Hathauri P.S. Case No.63 of 2016 instituted for the offence under Section(s) 394 Indian Penal Code.

It has been submitted that the name of this petitioner has been disclosed by co-accused, Subodh Kumar, who was arrested in another case and gave confessional statement. It has further been submitted that co-accused, Subodh Kumar, has already been granted bail by a co-ordinate Bench of this Court by order dated 11.01.2017 passed in Cr. Misc. No.46235 of 2016.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of `10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Muzaffarpur, in connection with Hathauri P.S. Case No.63 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
