Heard Mr. Ramakant Sharma, learned senior counsel for the petitioner.
The petitioner apprehends his arrest in connection with Complaint Case No. 507 of 2018, registered for the offences punishable undesr Section 498 A of the Indian Penal Code and Section 4(i) of Dowry Prohibition Act.
Patna High Court CR. MISC. No.51690 of 2019(10) dt.28-04-2022 2/3 As per allegation, the petitioner was married to the daughter of the informant on 21.04.2014. After the marriage all the accused persons demanded Rs. 25 lacs as dowry and due to non-fulfillment of the demand they misbehaved with her and lastly, they drove her away from her matrimonial house, keeping her belonging.
For amicable settlement of the issue, the matter was referred to Patna High Court Mediation and Conciliation Centre. The report of Mediator is annexed as flag 'M' which shows that both the parties have settled their dispute on full and final settlement of Rs. 13,00,000/- (Thirteen Lacs) . O.P. No. 3 became ready to withdraw all the cases including Complaint Case No. 507 of 2018. They also agreed to get a decree of divorce by mutual consent and after the decree of divorce, O.P. No. 3 shall be entitled to withdraw Rs. 5,00,000/- (Five Lacs) given to her by second bank draft.
Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Rohtas at Sasaram in
Patna High Court CR. MISC. No.51690 of 2019(10) dt.28-04-2022 3/3 connection with Complaint Case No. 507 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
