The petitioner apprehends his arrest in a case registered for the offence punishable under Section 420 of the Indian Penal Code.

The complainant alleged that the petitioner and other accused persons filed Title Suit No. 78 of 2010 for partition of the property in the permanent Lok Adalat in which the petitioner and others stated that the complainant died.

It is submitted that the complainant has filed a case for setting aside the compromise decree. Similarly situated accused persons have already been granted anticipatory bail vide orders passed in Cr. Misc. No. 34889 of 2014. The complainant O.P. No.

Patna High Court Cr.Misc. No.16006 of 2015 (4) dt.30-10-2015 2/2 2 was issued notice and she received the notice personally, but did not appear. The petitioner has already surrendered in the court in pursuance of the order dated 02.09.2015 and he has been granted provisional bail.

Considering the facts aforesaid, provisional bail granted to the petitioner is hereby confirmed and the petitioner is allowed to remain on the same bail bonds.
