The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 302, 201, 326 and 365/34 of the Indian Penal Code.

It is contended on behalf of the petitioner that there is no apparent relationship between the family of the deceased and the petitioners, however, it has come during the course of investigation that there was love affair between the petitioner no. 1 and the deceased and they were caught red handed by the

Patna High Court Cr.Misc. No.21921 of 2017(3) dt.19-09-2017 2/2 villagers. They were scolded and chastised by the villagers that had led to the deceased to commit suicide. She was also taken to the hospital but she died. It is urged that it has also come during investigation that all the sides had participated in cremation. It is further contended that the FIR has been lodged after about twenty one days of the occurrence.

Having regard to the facts and circumstances of the case, let the petitioners, above named be released on bail in the event of their arrest/surrender before the court below within a period of six weeks from today in connection with Sugauli P.S. Case No. 198 of 2016, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran at Motihari or his successor subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
