The petitioner apprehends his arrest in connection with POCSO Case No. 50 of 2017 arising out of Sour Bazar P.S. Case No. 430/17 registered for the offences punishable under Sections of the Indian Penal Code.
Learned counsel for the petitioner submits that the victim girl in her statement recorded under Section 164 Cr. P.C. has clearly stated that the petitioner has not abducted her and she had gone out of her own sweet-will and, thereafter, solemnized marriage. It is further submitted in the statement under Section 164 Cr. P.C. that it was only because her parents had threatened to kill her and the petitioner, she was constrained to leave home and come to the present petitioner.

No.16690 of 2018 (2) dt.10-04-2018 2/2 Having heard learned counsel for the parties and upon consideration of the entire facts and circumstances of the case and especially in view of the fact that the petitioner is not having any criminal antecedent, let the petitioner in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned 1st Additional Sessions Judge, cum Special Judge, Saharsa, in connection with POCSO Case No. 50 of 2017 arising out of Sour Bazar P.S. Case No. 430/17, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
