JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 03-05-2017 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner wants to renew his prayer for bail which was earlier twice rejected vide order dated 14.12.2015 and 05.10.2016 passed in Cr. Misc. Nos. 47681 of 2015 and 42400 of 2016 on the ground that the petitioner is suffering in custody since 27.05.2017 and there is no eye-witness of the occurrence. Three witnesses only have stated that they have seen the petitioner with handle of hand pump having blood stain to which the learned A.P.P. submits that the petitioner has confessed his guilt also but fairly submits that the trial has not been concluded within six months.

In the facts and circumstances stated above, finding

Patna High Court Cr.Misc. No.19040 of 2017 (2) dt.03-05-2017 2/2 no good ground for reconsideration of prayer for bail, again the prayer for bail of the petitioner stands rejected. However, the learned trial court is directed to expedite the trial and conclude the same as early as possible preferably within three months after taking the same on priority basis, failing which if the petitioner at no fault, may be at liberty to renew his prayer for bail.
