Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Sonbarsa P.S. Case No. 25 of 2021 lodged under Sections 363, 366(A)/34 of the I.P.C. read with Section 8 of POCSO Act. As per the prosecution case, the allegation of kidnapping with a view to kill and do wrong act with the victim was alleged against the 5 named accused including the present petitioner.
Learned counsel for the petitioner submits that antecedent of the petitioner is clean. Counsel submits that petitioner is in custody since 10.03.2022. Counsel submits that

No. 57348 of 2022(2) dt.05-12-2022 2/2 the anticipatory bail application of the petitioner was allowed by the Co-ordinate Bench of this Court vide order dated 14.07.2022 passed in Cr. Misc. No. 64862 of 2021 but due to miscommunication, the counsel for the petitioner was unaware that the petitioner has already arrested on 10.03.2022 in this case. Learned counsel for the State opposes the prayer for bail.
In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-VI, cum Special Judge (POCSO) Sitamarhi in connection with Sonbarsa P.S. Case No. 25 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C.
With this observation, the bail application stands allowed.
