JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 17-03-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Basantpur P.S. Case No.54/15 registered under Sections 406, 409, 420, 468, 471, 504 and 120(b) of the Indian Penal Code. The accusation is that the petitioner Nawal Kishore Prasad and one Rajeshwar Prasad representing themselves as Manager and Assistant Manager of O.S.W. Midia Index Limited, National Service,, 1st Floor, Sharma Complex lane, Krishna Cinema, Station Road, Siwan, asked the informant and the witnesses to deposit money in the company with contention to return the principal amount with high interest.after one year and also to open the recurring account. No.12192 of 2017 (2) dt.17-03-2017 2/2 deposited Rs.81,000/- and similarly other persons also deposited the money but deposited money was not returned in time and the petitioner and his associates left Siwan town closing the office. Learned counsel for the petitioner submits that, in fact, the petitioner was in the Company and he has been also cheated by the Company. Moreover, the petitioner is in custody since 11.04.2016 and the charge sheet has already been submitted against the petitioner.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-VI, Siwan, in connection with Basantpur P.S.Case No.54/15.
