The petitioners apprehend arrest in a case registered for the offence punishable under sections 379/34 and other ancillary sections of the Indian Penal Code.
Learned counsel for the petitioners submits that as per prosecution case petitioner no.1 and co-accused Tinku Sharma are alleged to have assaulted the informant causing him grievous injury. Petitioner no.2 is alleged to have assaulted son of the informant causing him simple injury. There is a case and counter case in which both sides sustained injuries. Petitioner has got no criminal antecedent.
In view of the fact that petitioner no.1 caused grievous
Patna High Court CR. MISC. No.64800 of 2021(3) dt.23-08-2022 2/2 injury, hence his prayer for pre-arrest bail is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice. Considering the fact that petitioner no.2 caused simple injury, his prayer for bail is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner no. 2 mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate Manjhaul, Begusarai in Cheriabariarpur Police Station Case No. 141/2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
