Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner seeks bail in a case registered for the offence under Sections 346, 363, 366(A), 367, 370, 370(A), 371, 372, 373, 354, 354(A), 354(B), 506, 509 of the Indian Penal Code, Sections 3,4,5,6,7 and 8 of the Immoral Traffic Act, Sections 8,12 and 17 of the POCSO Act and 75 of the J.J.Act. Earlier the prayer for bail of the petitioner was refused vide order dated 24.03.2022 passed in Cr. Misc. No.29491 of 2021.
Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.58737 of 2022(4) dt.04-01-2023 2/2 petitioner has clean antecedent. He has falsely been implicated in the present case. Petitioner is in custody since 31.12.2020. Vide order dated 19.10.2022 a report regarding present status of the trial was called for in Cr. Misc No.54935 of 2022. Report of the learned Trial Court dated 13.12.2022 reveals that the prosecution evidence has been closed on 07.12.2022 and the case is pending for statement under Section 313 of Cr. P.C. of the accused persons.
In view of the report of the learned Trial Court, I am not inclined to enlarge the petitioner on bail in connection with Majhauliya P.S.Case No.842 of 2020 pending in the court of learned Special Judge POCSO-cum-Additional District and Sessions Judge 6th, Bettiah, West Champaran.
Prayer is refused.
However, the learned Trial Court is directed to expedite the trial and conclude the same as early as possible. (Rajesh Kumar Verma, J) Nitesh/- U T
