JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-10-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named but omnibus allegation has been levelled against petitioner and several other FIR named accused persons.

No doubt, the occurrence took place in the year, 2005 and petitioner could be remanded in this case on 17-11-2014 from Sikandara P.S. Case No. 149 of 2007 but submission on behalf of the petitioner is that the petitioner had gone Gujarat in connection with his livelihood and when he returned to his home, he came to know about the institution of the present case as well as Sikandara P.S. Case No. 149 of 2007. It is further contended on behalf of the petitioner that petitioner has already been granted privilege of bail

Patna High Court Cr.Misc. No.19673 of 2015 (5) dt.30-10-2015 2/2 in Sikandara P.S. Case No. 149 of 2007 by a coordinate bench of this court vide order dated 18-05-2015 passed in Cr. Misc. No. 15475 of 2015 and similarly, co-accused Prakash Yadav and Masudan Mahto have already been granted privilege of bail in the present case by a coordinate bench of this court by order dated 2212-2008 passed in Cr. Misc. No. 36570 of 2008 & analogous cases.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Sikandara P.S. Case No. 168 of 2005 to the satisfaction of Sri Shyamal Kumar, J.M.-Ist Class, Jamui. (Hemant Kumar Srivastava, J) A.K.V./- U T
