2. The petitioners apprehend arrest in connection with Hajipur Sadar P.S.Case No.565 of 2017 registered for an offence under Sections 379 and other ancillary Sections of the IPC.
3. It has been submitted that the petitioners had given Rs.4 lacs to the informant for purchasing land for them. But neither the land has been purchased nor the money has been returned in spite of repeated request. It has been further submitted that the allegation of assault and snatching of money is omnibus. The informant has lodged this case only to digest the said four lacs rupees which was given as earnest money to the informant. The petitioners are full brothers having clean antecedent and so they
Patna High Court Cr.Misc. No.3268 of 2018 (2) dt.01-02-2018 2/2 deserve anticipatory bail.
4. However, learned APP opposed the submissions.
5. Considering the aforesaid facts and circumstances, the prayer for anticipatory bail is allowed. Let the above named petitioners in the event of their arrest or surrender before the court below within six weeks from today be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of CJM, Vaishali at Hajipur in connection with Hajipur Sadar P.S.Case No.565 of 2017 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
