JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 20-03-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 452, 376, 511, 427, 34 of the Indian Penal Code.
It is alleged against the petitioner that he made an attempt to commit rape upon the informant. It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. It is further submitted that both the parties are co-villagers and in the background of some dispute between the parties, the present accusation has been levelled against the petitioner.

In pursuance to the direction of this Court, a report with regard to the present stage the case has been received and it has been kept at Flag-B. The report suggests that up-til-now, no prosecution witness has been examined.
Considering the facts aforesaid and the fact that trial is not likely to be concluded in near future, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge 15th, Muzaffarpur in connection with Minapur P.S. Case No. 17 of 2006.
