Similar issue has been examined by this Court earlier in CWJC No.7122 of 2012 (Sanjay Kumar Verma Vs. The State of Bihar & Ors.) decided on 10th January,2013 and later in CWJC No. 17472 of 2014 ( Daya Shankar Prasad Vs. The Governor of Bihar & Ors.) decided on 9th September, 2015.
